These Terms of Service (“Terms”) govern your access to and use of http://blackseedoilgummies.com (the “Site”) and your purchase of products offered through the Site.
The Black Seed Oil Gummies brand and products are owned and/or produced by Obsidian Herbal Health LLC (“Obsidian”). Products offered to customers in the United States through this Site are distributed and sold by N’Ya Face Resources LLC (“N’Ya Face”), an authorized U.S. distribution and sales partner of Obsidian.
Throughout these Terms, Obsidian and N’Ya Face may collectively be referred to as “we,” “us,” or “our.”
By accessing the Site or purchasing a product, you agree to these Terms.
1. Eligibility and Use of the Site
You must be at least 18 years old or the age of majority in your jurisdiction to place an order through the Site.
You agree to provide accurate and complete information when making a purchase and not to use the Site for unlawful, fraudulent, or unauthorized purposes.
We reserve the right to refuse service, cancel orders, limit quantities, or restrict access to the Site when reasonably necessary to prevent fraud, misuse, regulatory violations, or other unlawful activity.
2. Products and Dietary Supplement Notice
Black Seed Oil Gummies are dietary supplement products.
Product descriptions, ingredient information, images, serving information, and other materials are provided for informational purposes. We make reasonable efforts to ensure this information is accurate, but packaging or product information may occasionally change.
Customers should review the actual product label before use.
These statements have not been evaluated by the Food and Drug Administration. This product is not intended to diagnose, treat, cure or prevent any disease.

3. Orders
Submitting an order does not guarantee acceptance.
We may reject, limit, or cancel an order for reasons including suspected fraud, incorrect pricing, inventory issues, payment authorization problems, shipping restrictions, or other legitimate business reasons.
If payment has already been collected for an order that we cancel, the applicable amount will be refunded.
4. Pricing and Payment
Prices are displayed in U.S. dollars unless otherwise stated.
Prices, promotions, discounts, product availability, and shipping charges may change without notice.
Applicable sales taxes and shipping charges will be calculated or displayed during checkout when required.
You authorize us and our payment service providers to charge the payment method submitted with your order for the total amount shown at checkout.
5. Shipping and Delivery
Orders are shipped according to the shipping options and rates displayed at checkout and described in our Shipping Policy.
Estimated delivery dates are estimates and are not guarantees. Delays caused by shipping carriers, weather, incorrect addresses, government actions, or other circumstances outside our reasonable control may occur.
Customers are responsible for providing a complete and accurate delivery address.
6. Returns and Refunds
Returns, exchanges, damaged products, missing shipments, and refunds are governed by our Return and Refund Policy, which is incorporated into these Terms by reference.
Nothing in these Terms limits any refund, replacement, warranty, or other consumer right that cannot legally be waived.
7. Product Safety and Adverse Events
Customers should discontinue use and seek appropriate medical attention if they experience a serious or unexpected reaction.
Product complaints or suspected adverse events should be reported promptly using the contact information provided on the Site.
Obsidian and N’Ya Face may request information reasonably necessary to investigate a product complaint, including the product name, lot number, purchase information, photographs, nature of the complaint, and relevant contact information.
We reserve the right to suspend sales, issue safety notices, request product returns, or conduct a product recall when appropriate or required by law.
8. Marketing and Product Claims
Statements concerning the characteristics or potential benefits of our products are intended to comply with applicable laws governing dietary supplements and advertising.
No statement on the Site should be interpreted as representing that a dietary supplement diagnoses, treats, cures, or prevents a disease unless expressly permitted by applicable law.
Customer testimonials describe individual experiences and do not guarantee that another customer will experience the same results.
9. Intellectual Property
The Black Seed Oil Gummies name, branding, packaging, graphics, photographs, logos, product descriptions, trademarks, and other proprietary materials are owned by Obsidian Herbal Health LLC, N’Ya Face Resources LLC, their licensors, or other applicable rights holders.
You may not reproduce, distribute, modify, sell, exploit, or use our intellectual property for commercial purposes without prior written authorization from the applicable rights holder.
10. Role of the Parties
Obsidian Herbal Health LLC is the product company and is responsible for the product functions and responsibilities assigned to it under applicable law and its agreements with N’Ya Face Resources LLC.
N’Ya Face Resources LLC serves as an authorized U.S. sales and distribution partner and does not represent itself as the manufacturer of products that it does not manufacture.
Nothing in these Terms creates a partnership, employment relationship, franchise, or joint venture between a customer and either company.
The respective responsibilities between Obsidian and N’Ya Face are governed by separate agreements between those companies and are not altered by these customer-facing Terms.
11. Disclaimer of Warranties
To the fullest extent permitted by applicable law, the Site and its content are provided on an “as available” basis.
Except for warranties that cannot legally be excluded, we disclaim implied warranties to the extent permitted by law.
We do not guarantee that the Site will operate continuously or without errors or that a particular product will produce a specific health or wellness result.
12. Limitation of Liability
To the fullest extent permitted by applicable law, neither Obsidian Herbal Health LLC nor N’Ya Face Resources LLC will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of the Site or purchase of products.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by law, including rights or remedies available under applicable consumer-protection or product-liability laws.
13. Third-Party Services
The Site may use third-party services such as Shopify, payment processors, shipping carriers, analytics providers, and other service providers.
Those providers may maintain their own terms and privacy practices. We are not responsible for independent actions of third parties outside our reasonable control.
14. Privacy
Personal information collected through the Site is handled according to our Privacy Policy.
By using the Site, you acknowledge that information necessary to process orders may be shared with service providers involved in payment processing, fulfillment, shipping, fraud prevention, customer service, and other legitimate business operations.
15. Errors and Corrections
We reserve the right to correct typographical errors, inaccurate product information, incorrect prices, availability errors, or other mistakes appearing on the Site.
If an error materially affects an order that has already been submitted, we may contact the customer, correct the order with authorization, or cancel and refund the affected transaction as appropriate.

Any dispute that is not otherwise resolved shall be brought in an appropriate court located in Philadelphia County, Pennsylvania, unless applicable law gives the customer another right.
18. Severability
If a provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.
